Intellectual Property & Infringement Policy

Office Planners Intellectual Property
The Office Planners® name, logo, Platform, website content, software, design, databases, graphics and other proprietary materials are owned by or licensed to Smartmove Global Platforms Private Limited and are protected under applicable intellectual-property laws.
Nothing in a user's access to or use of the Platform transfers ownership of Office Planners intellectual property to that user.
Except where permitted by applicable law, users must not reproduce, copy, modify, distribute, publish, commercially exploit or otherwise use Office Planners intellectual property without appropriate written permission.
Users may make accurate, factual references to Office Planners where doing so does not imply an endorsement, partnership, agency or other relationship that does not exist.
Trademarks & Brand Use
Registered trademarks, trade names, logos, brand elements and other identifiers belonging to Office Planners or Smartmove Global Platforms Private Limited may not be used in a manner likely to mislead, confuse, misrepresent affiliation or infringe applicable rights.
Partners must not represent themselves as employees, agents, representatives or authorised branches of Office Planners unless expressly authorised in writing by Office Planners.
Any permitted use of Office Planners branding must comply with applicable brand guidelines and prior written authorisation from Office Planners, where required.
Client, Partner & User Content
Clients, Partners and other users remain responsible for content they provide to Office Planners, including:
- logos and trademarks;
- photographs and images;
- portfolios and past-work samples;
- business descriptions;
- proposals and presentations;
- documents;
- text and other materials.
By providing content to Office Planners for use in connection with the Platform or an engagement, the user represents that they own the content or have the rights, licences, permissions or authority necessary to provide and permit its relevant use.
Users must not upload, submit or provide content that knowingly infringes the intellectual-property rights of another person.
Limited Licence to Office Planners
Where a Client, Partner or user provides content for use on or in connection with Office Planners, they grant Office Planners a limited, non-exclusive licence to host, reproduce, display, communicate and otherwise use that content only to the extent reasonably necessary to:
- operate the Platform;
- verify or present a Partner;
- facilitate matching and introductions;
- manage or document an engagement;
- provide applicable Platform services; or
- fulfil another purpose expressly authorised by the user.
This licence does not transfer ownership of the user's intellectual property to Office Planners.
Deliverables Created for Clients
Ownership and permitted use of work product, designs, documents, software, creative materials or other deliverables created by a Partner for a Client will be determined by the applicable proposal, scope, engagement terms or other agreement between the relevant parties.
Unless expressly agreed otherwise, Office Planners does not claim ownership of work product created by an independent Partner specifically for a Client.
Clients and Partners should clearly document intellectual-property ownership, licensing and usage rights where these are material to an engagement.
Reporting Suspected Infringement
If you believe that content available through the Office Planners Platform infringes intellectual-property rights owned by you or a person you are authorised to represent, please send a written notice to hello@officeplanners.in.
To help us review the matter, the notice should include, where reasonably available:
- your name, organisation and contact details;
- identification of the intellectual property or protected work concerned;
- information reasonably sufficient to identify the allegedly infringing content;
- the relevant Platform location, page or other identifying information;
- an explanation of the rights you claim and why you believe the use is unauthorised;
- supporting documentation where appropriate;
- a statement that the information provided is accurate and that you are the rights holder or are authorised to act on behalf of the rights holder; and
- your physical or electronic signature or other appropriate confirmation.
Submitting incomplete information may delay our ability to review a complaint.
Review & Action
Office Planners may review an infringement notice and request additional information where reasonably necessary.
Depending on the circumstances, Office Planners may take appropriate action, including:
- contacting the user who provided the disputed content;
- temporarily restricting access to the content;
- removing or disabling content;
- requesting evidence of ownership or permission;
- restoring content where appropriate; or
- suspending or terminating users for serious or repeated violations.
The submission of a notice does not automatically require Office Planners to remove content where the claim cannot reasonably be verified or removal is not required by applicable law.
Counter-Response
Where content has been restricted or removed following an infringement complaint, the affected user may contact hello@officeplanners.in and provide a counter-response explaining why they believe the restriction or removal was made in error.
The counter-response should include relevant supporting information regarding ownership, authorisation, licensing or another lawful basis for use.
Office Planners may consider information provided by both parties and take further action as reasonably appropriate and permitted by applicable law.
Sharing Information Relating to a Complaint
Where reasonably necessary to investigate or resolve an infringement complaint, Office Planners may share relevant information from a complaint or counter-response with the affected user, rights holder, authorised representative, professional adviser or competent authority.
Personal data will be handled in accordance with the Office Planners Privacy Policy and applicable law.
Misuse of the Infringement Process
Users should not knowingly submit false, misleading, fraudulent or abusive infringement notices or counter-responses.
Office Planners may take appropriate action where its infringement process is deliberately misused.
Repeat or Serious Infringement
Repeated or material infringement of intellectual-property rights may result in restriction, suspension or termination of access to Office Planners, subject to applicable terms and law.
No Determination of Ownership Disputes
Office Planners may facilitate the review of content available through its Platform but is not a court or tribunal and does not necessarily determine the ultimate ownership or validity of disputed intellectual-property rights.
Where an ownership or infringement dispute cannot reasonably be resolved through the Platform process, the relevant parties may need to pursue their rights through appropriate legal channels.
Governing Law & Disputes
This Policy is governed by the laws of India. Applicable jurisdiction, dispute-resolution and arbitration provisions are contained in the Office Planners Terms of Use.
Changes to This Policy
Office Planners may update this Policy from time to time to reflect changes in the Platform, business operations or applicable requirements.
The Last Updated date displayed at the top of this Policy will identify the latest version.
